Terms & Conditions
1.1. Submitting a photo and otherwise participating in this Competition constitutes acceptance of these terms and conditions (“Terms and Conditions”). Information on how to enter and prize information form part of these Terms and Conditions. Entries must comply with these conditions to be valid.
2.1. The Promoter is Nikon Australia PTY LTD, trading as Nikon Australia (ABN 34 121 761 537) of Rider Blvd, Rhodes NSW 2138.
3.1. The Competition is only open to individuals who:
i. are residents of Australia and are aged 16 years or older at the time of entry
ii. are members of “My Nikon Life” database and have a valid My Nikon Life account
iii. have a public Facebook or Instagram account, and
iv. are not directors, management or employees of the Promoter or its related companies or agencies associated with the Competition, or their immediate family members, (“Entrant”).
4. 1. The competition in its entirety commences at 10.00am AEDT on 28/02/2022 and closes at 11.59pm AEST on 17/04/2022 (“the Competition Period”), featuring 4 fortnightly themes, each with an entry period of 1 week and a judging period of 1 week. Except as otherwise stated, all times are AEDT time. Entries must be received by the Promoter during the Entry Period (4.1.2) of each respective theme.
THEME TWO – NIGHT LIGHT
Entries received after the times outlined below for the Night Light theme will not be accepted:
4. 1.2 Entries open: Monday 14th March. Entries close: Sunday, 20th March 11:59pm AEDT.
5.1. To enter the Competition an Entrant must, during the Entry Period:
i. enter a photo taken within the last year in Australia that showcases their interpretation of Night Light. Entries are to be submitted between 14/03/2022 and 20/03/2022 11:59pm AEDT
ii. submit the photo via nikon.com.au, where they will need to be logged in to their My Nikon Life account (or create an account) to enter.
5.2. One entry is permitted per entrant for each theme (4 total entries can be submitted during the competition period). Each photo will need to be submitted as a separate entry during the theme’s respective entry period, following the instructions set out in clause 5.1. Each remaining theme, prize and judge will be announced prior to its respective Entry Period.
5.3. Entries may be captured using any device with photo capabilities, including but not limited to a camera, mobile phone, tablet and/or computer.
5.4. The Promoter will accept all entries that successfully follow the instructions. If Entrants live outside Australia, have obtained the photo unlawfully, are not within the ages explicitly specified, and/or their individual submission does not adhere to the Terms and Conditions listed, their entry into the Competition will not be approved/allowed.
5.5. The Promoter takes no responsibility for any failure to receive an entry, for late, lost, incomplete, incorrectly submitted, illegible or misdirected entries or for any delays or failures in telecommunications service or equipment. If such problems arise, then the Promoter may modify, cancel, terminate or suspend the Competition.
5.6. Entries must not be unlawful, offensive, defamatory, derogatory, racist or otherwise inappropriate. Any entry which the judges deem inappropriate will be invalid.
5.7. Cost of entry via the internet is free, but internet connection and usage rates may apply. Entrants should obtain details of such costs from their service provider.
6.1. For theme two (Night Light) there is one prize to be won in total. The prize for the winner consisting of:
Z 5 + NIKKOR Z 24 – 200mm f/4 – 6.3
6.2. This prize non-transferable or exchangeable as cash. The Promoter accepts no responsibility for any variation in prize value between themes.
6.3. If the prize becomes unavailable for reasons beyond the Promoter’s control, the Promoter may substitute a prize of equal or greater value.
7.1. Judging will take place between 21/03/2022 and 24/03/2022
7.2 Winner will be announced on Nikon.com.au and Nikon Australia Facebook and Instagram on 25/03/2022.
7.3. Entries will be judged by a panel of judges, including:
i. Heesoo Chung
ii. Nikon Australia.
7.3. The Competition is a game of skill. Chance plays no part in determining the winners. All entries will be judged individually on their merits, based on the creativity and originality of the photograph. The judges’ decision is final and binding – no correspondence will be entered into.
7.4. The prize winner will be contacted via private Facebook or Instagram message to the winners’ profiles or via Email during the Judging Period and must respond within 1 day in order to verify their identity and provide their email and mailing address to receive the prize. The name of the prize winner will be published on the Nikon Australia Instagram and Facebook pages by 25/03/2022. Prizes will be mailed to the winner after verification and receipt of address details. Prizes will be mailed to Australian postal addresses only.
7.5. If the winner does not respond to the private message in accordance with clause 7.4, the winner will forfeit the prize and the prize will be awarded to the next best entry (as determined by the judges). The Promoter will not be liable for a winner who does not respond to the Promoter’s direct private message and therefore forfeits their prize and no correspondence will be entered into.
7.6. Entrants whose images are shortlisted by the judges may be required to produce the original unaltered camera image in camera RAW format (or other format, such as unaltered JPEG if RAW was not used) so that compliance with the Terms and Conditions can be assessed. Failure to supply the original image within 1 day of such request may result in disqualification by the Promoter. Judges and the Promoter will have sole discretion as to whether an image entered into the competition has been in compliance with the Terms and Conditions.
7.7. The Promoter reserves the right to disqualify Entrants at its sole discretion for reasons that may or may not be disclosed to the disqualified Entrant.
8.1. Entrants retain the copyright of each entry as its author.
8.2. Entrants confirm and promise that their entry is original and does not infringe the intellectual property rights of any third party. Your entry must not be copied or contain any third-party content that you do not have permission to use.
8.3. Entrants confirm that where an individual is featured in their entry, the featured individual has given consent to use their image in connection with your entry into the Great Australian Light competition. If the individual is aged less than 18 years, the entrant must seek consent from the parent or guardian.
8.4. Entrants agree that the Promoter has an unrestricted, irrevocable, transferable, divisible right and license to use and modify their entry for the purposes of promoting the Great Australian Light competition without the payment of any further fee or compensation. Such use may include social media channels, website and email marketing. If requested by the Promoter, the entrant agrees to sign any further documentation required by the Promoter to give effect to this arrangement. To the extent permitted by law, entrants unconditionally and irrevocably consent to any act or omission that would otherwise infringe any moral rights in their entry.
9.1. Entrants consent to the Promoter using their name, image and/or voice in the event that they are a winner on social media for an unlimited period of time without remuneration for the purpose of promoting this competition (including any outcome) and/or promoting any products manufactured, distributed and/or supplied by the Promoter.
9.2. The Promoter reserves the right, at any time, to verify the validity of entries and eligibility of Entrants (including an Entrant's proof of identity, proof of age, and proof of residency) and any other information from entrants relevant to entry into or participation in this competition. Verification is at the discretion of the Promoter, whose decision is final.
9.3. The Promoter reserves the right to disqualify any individual who provides false information, fails to provide information, conspires with others to gain an unfair advantage or who is otherwise involved in any way in manipulating, interfering or tampering with the conduct of this Competition.
